Overview: Reporting to Bekaert’s Vice President Group Ethics and Compliance, the Compliance Manager APAC will provide leadership for implementation of the Bekaert’s Ethics and Compliance program within the APAC region and provide Ethics and Compliance counseling and support to the business.
Position Information
The successful candidate will serve as the primary compliance manager to the APAC (NAS, SEA) region, directing the implementation and oversight of Bekaert’s global Ethics and Compliance program and promoting the company’s culture of integrity within the region. S/he will have a minimum of 5 years compliance-related work experience in China or the APAC region as part of a corporate legal or internal audit department including experience with anti-bribery/anti-corruption regulations, anti-competitive behavior, data privacy/protection, fraud-related issues, compliance investigations, and business/commercial crime.
Your Role
Specific responsibilities of the Compliance Manager APAC will include:
• Leadership for implementation of the company’s Ethics and Compliance program and promoting the company’s culture of integrity in APAC.
• Serving as the primary compliance contact to the region and providing ethics, business conduct, and legal compliance training, guidance, and advice within the APAC region
• Reviewing compliance policies, guidelines, procedures, and initiatives and providing guidance and recommending enhancements to controls, communication and effectiveness based on risk within the APAC region.
• Oversight and support in the implementation of compliance policies, guidelines, and procedures
• Provides region specific input to the Ethics and Compliance program and assists in the adaptation to local legal and cultural requirements.
• Assist with the design and delivery of compliance-related eLearning and face-to-face training
• Reporting on the effectiveness of the Ethics and Compliance program within the APAC region. Responsible for analyzing Compliance Key Performance Indicators (KPIs) and promoting improvement initiatives.
• Co-leading the North-Asia and South-East Asia Regional Compliance Committees
• Partnering with the business leadership throughout the region to facilitate Ethics and Compliance risk awareness, monitoring of emerging regional and local risks and development of risk mitigation strategies and controls to support business initiatives.
• Identifying new developments and changes to applicable laws or regulations within the APAC region that may impact the Ethics and Compliance program and proactively communicating such developments or changes.
• Advise and assist regional business leadership with implementation of remedial measures to address risk, control failures and compliance concerns.
• Conducting due diligence related to Compliance and Ethics, supporting the review and approval process for all high-risk customers (e.g. SOEs) and vendors due diligence applications for the APAC region
• Effectively control the compliance risks in APAC region of third-party agents/distributor/consultants/JV partners of our business units by conducting due diligence, managing the on-boarding process, and overseeing the investigation of reported violation of Bekaert ABC policy and monitoring third-party compliance risks.
• Effectively collaborating with other functions (e.g., Internal Audit, China Security team, Regional Legal team) within the APAC region to leverage resources and compliance-related processes and activities.
• Promoting the use of the company’s integrity reporting channel and analyzing integrity case statistics to identify emerging trends and areas of compliance focus within the APAC region.
• Overseeing the compliance investigation process in the APAC region: (1) assisting the China Security investigation team with investigations in China, (2) leading investigations in the North-Asia and SEA regions and coordinating the effective resolution of remediation plans in cooperation with the Group Compliance Manager and VP Group Ethics and Compliance
• Partnering with Group Compliance Manager, Data Privacy Manager, Vice President Group Ethics and Compliance, the Regional Compliance Liaisons, and the Regional Legal team to assure consistent application and implementation of the global Ethics and Compliance program.
• Assist with identification and implementation of continuous improvement opportunities in the Ethics and Compliance program, policies, and procedures.
Your Profile
This position requires an experienced Compliance professional with a strong business orientation. Emotional maturity and the personal and professional ‘fit’ within Bekaert’s culture is very important. Candidates must be self-motivated and exhibit a passion for Bekaert’s company values, understanding Bekaert’s business and contributing in a meaningful way to its strategy and long-term strategic goals. In addition to possessing the requisite legal and technical skills, the successful candidate must demonstrate a high degree of ethics and integrity, must be able to communicate effectively with different stakeholders in the organization (incl. various management levels), as well as strategic/conceptual thinking capabilities.
• Minimum of 5 years’ compliance-related work experience, ideally combined with a finance background, including experience with anti-bribery/anti-corruption regulations, anti-competitive behavior, data privacy/protection, fraud-related issues, and compliance investigations
• Demonstrated the ability to manage compliance programs; to effectively provide training and communicate standards of conduct, legal principles, and behavioral expectations, and to advise management on compliance related issues
• Demonstrated the ability to conduct compliance due diligence
• Travel required which includes some international travel
• Strong oral and written communication skills. Written and spoken Chinese and English skills required
